Terms of Service

1. Who you are contracting with

These Terms form an agreement between you and Derelict ("we", "us", "our") covering your use of the Derelict Atlas website and service (the "Service").

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms and to our Privacy Notice. If you do not agree, do not use the Service. You confirm you are of legal age and, if acting for an organisation, have authority to bind it.

3. The Service

Derelict Atlas is an information service about abandoned and derelict locations, offered on a freemium basis with optional Premium features. Content is provided for informational purposes only; entering any location is your own decision and risk.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully or to encourage trespass, vandalism, or theft.
  • Commit fraud, spam, or impersonate others.
  • Infringe intellectual property or privacy rights of third parties.
  • Interfere with security, probe, scrape, or upload malware.
  • Resell, redistribute, or reverse engineer the Service.

5. Accounts

You are responsible for keeping your credentials confidential and for activity under your account. Provide accurate information and keep it current.

6. Intellectual property

The Service, including its software, design, branding, and curated content, is owned by Derelict and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

7. Payments and subscriptions

Payments are processed by Stripe. Subscriptions renew automatically at the interval shown at checkout until you cancel. You can cancel at any time from your account page; cancellation stops future renewals but does not refund the current period unless our Refund Policy applies. Taxes are calculated and collected at checkout where applicable.

8. Service availability

We aim to keep the Service running but do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You can stop using the Service at any time. On termination, your right to use the Service ends.

10. Liability

To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid for the Service in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where excluding it would be unlawful.

11. Indemnity

You will indemnify Derelict against claims arising from your content, unlawful use of the Service, or breach of these Terms.

12. Changes

We may update these Terms. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction where Derelict is established. Disputes will be brought before the competent courts of that jurisdiction.
